Pengadilan Negeri Banjarbaru kembali menggelar sidang lanjutan dugaan kasus penipuan dan penggelapan usaha bisnis batu bara, pada Senin (20/11/2023) siang.
Korankalimantan.com – Persidangan dengan agenda pembacaan replik atau jawaban atas pleodi oleh Jaksa Penuntut Umum, terhadap empat terdakwa AC direktur PT.EEI TBK, HS direktur PT.EGL, KH pemegang saham PT.EEI serta DH, dalam kasus dugaan penipuan dan penggelapan bisnis batu bara.
Salah satu point replik yang dibacakan oleh JPU di depan Majelis Hakim itu diantaranya, tetap pada keyakinanya yakni sesuai dengan tuntutan awal, yang mana para terdakwa dituntut pidana penjara selama 3 tahun 10 bulan.
Usai persidangan tim kuasa hukum terdakwa Pahrozi dari kantor hukum Equitable law firm mengatakan, jawaban dari JPU seharusnya tidak perlu, karena pihaknya menilai tidak ada fakta persidangan yang dibantah oleh tim Jaksa Penuntut Umum, padahal persidangan itu sejatinya membuktikan fakta persidangan.
“Replik itu sesungguhnya kan membantah atas pledoi, namun kami memandang sejatinya tidak perlu dijawab. Kenapa, karena tidak ada fakta persidangan yang dibantah oleh tim Jaksa Penuntut Umum, padahal persidangan itu sejatinya membuktikan fakta persidangan, ranah majelis untuk membuktikan siapa yang bersalah atau tidak, unsur terbukti atau tidak, tetapi penuntut umum, pengacara, hakim, panitera wajib memastikan peristiwa apa yang terjadi di persidangan, itu penting”, Jelas Pahrozi.
Sementara itu salah satu terdakwa AC mengatakan, terkait replik Jaksa Penuntut Umum, dirinya tidak melihat fakta hukum yang selama ini berjalan di dalam persidangan.
“Mohon maaf saya melihat repliknya itu tidak melihat fakta hukum dan fakta persidangan yang ada serta banyak yang di abaikan, bahkan menurut saya ada yang tidak disampaikan dengan sebenar-benarnya, sehingga ini adalah tetap pemaksaan hukum, untuk pemaksaan kriminalisasi saya dkk. Supaya ini terjadi pidana, padahal jelas tidak ada tindak pidana,” ungkapnya.
“Saya ulagi lagi Pertama H.sar,i tidak pernah membayar PPJB, dan sudah diakui di fakta persidangan, dan tidak diungkap di dalam replik JPU, yang kedua dikatakan bahwa H.sar,i telah membayar giro atau BG tidak ada hal seperti itu yang terjadi”, tambahnya.
Pada sidang sebelumnya yang turut dihadiri penghubung Komisi Yudisial Kaimantan Selatan dan puluhan karyawan, pada sidang kali ini sejumlah karyawan kembali menyaksikan jalannya persidangan, dimana sama seperti kemarin, mereka serempak mengenakan pakaian kaos putih bertuliskan “Tolak Kriminalisasi”.
Sebagaimana diketahui kasus ini mengemuka diawali dari adanya perjanjian pengikatan jual beli saham (PPJB Saham) yang selama ini menjadi dasar bagi Sar’i (Pelapor) untuk mengklaim sebagai pihak yang berhak atas 40% saham dalam PT Indomarta Multi Mining (PT IMM), tidak pernah terealisasi, dan tidak pernah melakukan transaksi pembayaran atas nilai saham sebagaimana yang tercantum dalam PPJB Saham tersebut. Atas tidak dilakukannya Pembayaran dalam PPJB tersebut oleh Sar’i, maka akta jual beli saham (AJB Saham) tidak pernah terjadi, sehingga terungkap fakta hukum dalam persidangan bahwa peralihan hak atas saham sebanyak 40% tersebut ternyata selama ini tidak pernah terjadi.
Sementara itu dalam persidangan juga terungkap adanya seputar perjanjian utang piutang antar pihak, termasuk pemberian saham sebesar 40%. Hal itu dilakukan diduga lantaran tidak terpenuhinya uang yang mau diserahkan yakni sebesar 72 miliar rupiah, namun hanya sebesar 49,5 miliar rupiah saja.
Belakangan para terdakwa merasa kasus tersebut terkesan dipaksakan ke ranah pidana, sehingga merasa dikriminalsiasi, setelah para terdakwa dikenakan pasal berlapis, yakni Pasal 378 dan Pasal 372 KUHP tentang penipuan dan penggelapan.
Selain itu tim kuasa hukum juga mempertanyakan proses mekanisme selama proses penyelidikan hingga penyidikan, dimana menurut kabar bahwa para terdakwa ini setelah satu hari dilakukan penahanan oleh pihak Kejaksaan, besok harinya atau satu hari setelahnya berkas perkara tersebut sudah dinyatakan lengkap, dan langsung dilimpahkan ke Pengadilan Negeri Banjarbaru untuk menjalani proses persidangan. Menurut pandangan mereka peristiwa ini mirip dengan kejadian di Lampung Utara, sebagaimana pemaparan Komisi III DPR RI dengan Kejaksaan Agung RI, dinyatakan oleh Arteria Dahlan ada kasus warga jadi korban oknum Jaksa ditahan 1 hari besok langsung dilimpah ke Pengadilan.
